Vaccine Mandate for U.S. Businesses Stopped by Supreme Court

WASHINGTON D.C. (OnFocus) – A mandate enacted by the Biden Administration that would have required U.S. businesses with more than 100 employees to enforce COVID-19 vaccination requirements or a weekly negative COVID test has been struck down by the Supreme Court.

The mandate was set to affect all private companies located in the U.S. that had over 100 employees. According to reports, the court did not block requirements of a similar sort for medical facilities that accept medicare and medicaid payments.

“Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the court’s written opinion said.

The ruling comes just days after an OSHA emergency temporary standard went into place requiring employees to be vaccinated or receive a weekly negative test in order to come to work.

“Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category,” the court said.
