Judge Rules Greenwood Man Incompetent to Stand Trial

OnFocus – Justin Dunlap, a 28-year-old Greenwood man appeared today in Clark County Circuit Court for a competency hearing.

The court determined that the State had met its burden and believes that Dunlap is not competent to stand trial at this time, but can be restored to competency within 12 months. The State requested a medication and treatment order. Dunlap will undertake an outpatient restorative program, with check-ins at 3, 6, and 9 months. After competency, the court will decide on further actions.

Dunlap was charged February 5 with seven counts of possession of child pornography, a class D Felony.

Investigator Noah Lobner of the Clark County Sheriff’s Office was assigned to the case after a CyberTip from the Wisconsin Department of Justice (DOJ) – Division of Criminal Investigation (DCI) – Internet Crimes Against Children Taskforce (ICAC). The CyberTip was sent to DOJ from the National Center for Missing and Exploited Children (NCMEC.)

According to the criminal complaint, child pornography was located on Dunlap’s cell phone. Files were uploaded to a Dropbox account which showed subscriber information related to Dunlap. Dropbox provided Dunlap’s account as part of a warrant search. During the investigation, Lobner found that the Dropbox account contained 2,962 files and 28 folders, and almost all of the files and folders contained in this Dropbox account had some type of pornography.

Lobner, Deputy Niemi, Greenwood Chief Bock questioned Dunlap in December 2019 and executed a search warrant of his phone, which revealed the presence of child pornography.
